Cultivate Social LLC ("Company," "we," "us," or "our") respects the intellectual property rights of others and expects users of our Service to do the same. This DMCA/Copyright Policy explains how copyright holders can report alleged infringement, how our Service responds to such reports, and what rights users have if they believe content was removed in error.
This policy is issued under the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512.
We have designated the following agent to receive notifications of claimed copyright infringement. Takedown notices, counter-notices, and copyright-related legal correspondence should be directed to this agent — not to our general support address.
Our designated agent is also registered with the U.S. Copyright Office. The current registration is publicly searchable through the Copyright Office's online DMCA agent directory.
If you believe that content on Cultivate Social infringes your copyright, you may submit a written notice of alleged infringement to our designated agent.
To be effective under the DMCA, your notice must include all of the following:
Notices that fail to meet these requirements may not be effective under the DMCA. We reserve the right to request additional information before acting on an incomplete notice.
Upon receipt of a valid DMCA notice, we will:
Section 512(f) of the DMCA imposes liability on any person who knowingly makes a material misrepresentation in a notice of infringement or a counter-notice. If you are not sure whether your use or another party's use constitutes infringement, we recommend consulting a qualified attorney before submitting a notice or counter-notice.
Fraudulent, abusive, or bad-faith takedown notices may be reported to appropriate authorities and may result in legal liability for the sender.
If your content was removed from the Service in response to a DMCA notice and you believe it was removed in error or as a result of misidentification, you may submit a written counter-notice to our designated agent.
To be effective under the DMCA, your counter-notice must include all of the following:
Upon receipt of a valid counter-notice, we will:
If no such notification is received within that timeframe, we will restore the material at our discretion.
It is our policy to terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers.
We consider a user a "repeat infringer" when the user has accumulated three or more separate, valid DMCA takedown notices against content they uploaded or published through the Service, within any rolling twelve-month period. We may terminate accounts earlier in cases of egregious or willful infringement.
Terminated accounts are not entitled to refunds of any prepaid subscription fees, content credits, or other purchased services. See our Refund Policy for additional detail.
The Service uses AI to generate content based on user-provided source materials. Because our AI providers are trained on large datasets that may include copyrighted works, generated content may occasionally resemble existing works.
7.1 User responsibility for generated output. Users are responsible for reviewing AI-generated content before publishing and for ensuring that published content does not infringe on third-party rights, as detailed in our Acceptable Use Policy and AI Content Disclosure.
7.2 DMCA notices regarding generated content. If you believe that content generated through Cultivate Social infringes your copyright, you may file a DMCA notice as described in Section 2. We will evaluate such notices under the same process as notices regarding user-uploaded material.
7.3 Source material infringement. If a user uploads source material (a sermon transcript, manuscript, or audio recording) that infringes your copyright, and the Service generates content based on that infringing source, the resulting content is subject to takedown under this policy. We will also take appropriate action against the user who uploaded the infringing source material.
We may update this DMCA/Copyright Policy from time to time. When we do, we will revise the "Last updated" date above and update our registration with the U.S. Copyright Office as required. Material changes will be communicated to account holders.
For DMCA-specific correspondence, use our designated agent contact information in Section 1.
For general questions about this policy that are not themselves DMCA notices, you may contact support@cultivate-social.app.
